The President of the Council, in exercise of the powers conferred by section 4(1) and (2) of the European Parliament (Pay and Pensions) Act 1979[1] and now vested in her[2], hereby makes the following Order: Title and commencement 1. This Order may be cited as the European Parliamentary (United Kingdom Representatives) Pensions (Amendment) Order 1997 and shall come into force on 4th June 1997. Interpretation 2. In this Order -
and other expressions shall have the same meaning as in the principal Order.
30A. - (1) As part of the arrangements for the resolution of disputes made in compliance with section 50 of the Pensions Act 1995[4], on the application of a complainant following a decision given in accordance with section 50(2)(a) of that Act, the Managers shall reconsider the matter in question and confirm the decision or give a new decision in its place. (2) In paragraph (1) above, "complainant" shall have the same meaning as "complainant of a prescribed description" in section 50(2)(a) of the Pensions Act 1995[5]."
This note is not part of the Order) This Order amends the European Parliamentary (United Kingdom Representatives) Pensions (Consolidation and Amendment) Order 1994. Section 50 of the Pension Schemes Act 1995 requires the trustees or managers of an occupational pension scheme to secure that the arrangements for the internal resolution of disputes required by that section are in place. The arrangements must provide for a person to give a decision on a dispute and, on the application of the complainant, for the trustees or managers to reconsider the matter. Article 30A confers on the Managers the function of reconsidering the matter.
