The Secretary of State, in exercise of the powers conferred on him by section 24(1)(c) of the Representation of the People Act 1983[1], hereby makes the following Order: 1 . - (1) This Order may be cited as the Returning Officers (Parliamentary Constituencies) (England) (Amendment) Order 1997 and shall come into force on 1st April 1997. (2) In this Order, "the 1995 Order" means the Returning Officers (Parliamentary Constituencies) (England) Order 1995[2]. 2 . In Schedule 1 to the 1995 Order (returning officers for certain borough constituencies outside Greater London), in the entry in the right-hand column opposite the name of the Brighton, Kemptown constituency, for "Brighton" there shall be substituted "Brighton and Hove". 3 . In Schedule 2A to the 1995 Order (returning officers for certain county constituencies)[3], after the entry for the Brigg and Goole constituency there shall be inserted in the left-hand column (name of county constituency) "Rutland and Melton" and opposite thereto in the right-hand column (county of which sheriff is returning officer) "Leicestershire". Tom Sackville Parliamentary Under-Secretary of State Home Office 27th February 1997 (This note is not part of the Order) Article 2 of this Order amends Schedule 1 to the Returning Officers (Parliamentary Constituencies) (England) Order 1995 ("the 1995 Order") to substitute the name of the District of Brighton and Hove, which is created by the East Sussex (Boroughs of Brighton and Hove) (Structural Change) Order 1995 (S.I. 1995/1770), for the name of the District of Brighton (which will cease to exist on 1st April 1997). Article 3 of this Order amends Schedule 2A of the 1995 Order in consequence of the creation of the County of Rutland by the Leicestershire (City of Leicester and District of Rutland) (Structural Change) Order 1996 (S.I. 1996/507). As a conseqence of the creation of that county, the Rutland and Melton constituency will straddle two counties and section 24(1)(a) of the Representation of the People Act 1983 (which applies where a constituency is wholly contained in a county) no longer operates to determine the returning officer for that constituency.
