SOCIAL SECURITY

The Social Security (Disability Living Allowance) Amendment Regulations 1997

  Made 13th February 1997 
  Laid before Parliament 20th February 1997 
  Coming into force 6th October 1997 

The Secretary of State for Social Security, in exercise of powers conferred upon him by sections 75 and 122 of the Social Security Contributions and Benefits Act 1992[1] and of all other powers enabling him in that behalf, and after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it[2], hereby makes the following Regulations:

Citation and commencement
     1 . These Regulations may be cited as the Social Security (Disability Living Allowance) Amendment Regulations 1997 and shall come into force on 6th October 1997.

Amendment of regulation 3 of the Social Security (Disability Living Allowance) Regulations 1991
    
2 . In regulation 3 of the Social Security (Disability Living Allowance) Regulations 1991[3] (age 65 or over) - 

    (a) in paragraph (1), for the word ", where - " there shall be substituted "if he is a person to whom paragraphs (2) and (3) apply."; and

    (b) sub-paragraphs (a) to (d) of paragraph (1) shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Social Security (Disability Living Allowance) Regulations 1991 (S.I. 1991/2890) are further amended so that persons over the age of 65 are no longer able to claim disability living allowance.

These Regulations do not impose a charge on business.
