The Secretary of State for Transport, being a Minister designated[1] for the purposes of subsection (2) of section 2 of the European Communities Act 1972[2] in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other powers enabling him in that behalf, hereby makes the following Regulations: - 1 . These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment) Regulations 1997 and shall come into force on 28th February 1997. 2 . - (1) Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 1992[3] shall be amended as follows. Signed by the authority of the Secretary of State for Transport John Bowis Parliamentary Under Secretary of State, Department of Transport 28th January 1997 (This note is not part of the Regulations) These Regulations amend Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 1992 and are made in consequence of Commission Directives 89/491/EEC, 96/20/EC, 96/44/EC, 95/54/EC, 95/56/EC, 96/37/EC, 96/38/EC, 96/64/EC, 96/36/EC, 95/48/EC, 95/28/EC and Directives 96/69/EC, 96/1/EC and 96/27 which were made by the European Parliament and Council. Directive 89/491/EEC amends Council Directive 70/157/EEC in relation to permitted sound levels and exhaust systems of motor vehicles, Council Directive 70/220/EEC in relation to emissions from motor vehicles, Council Directive 72/245/EEC relating to the suppression of radio interference on motor vehicles, 72/306/EEC in relation to emissions from diesel engines, 80/1268/EEC in relation to fuel consumption of motor vehicles and 80/1269/EEC in relation to the engine power of motor vehicles. Directive 96/20/EC further amends Council Directive 70/157/EEC in relation to permitted sound levels and exhaust systems of motor vehicles. Directive 96/44/EC further amends Council Directive 70/220/EEC in relation to emissions from motor vehicles. Directive 95/54/EC amends Council Directive 72/245/EEC the suppression of radio interference on motor vehicles. Directive 95/56/EC amends Council Directive 74/61/EEC in relation to anti-theft devices. Directive 96/37/EC further amends Council Directive 74/408/EEC in relation to the strength of seats and their anchorages in motor vehicles. Directive 96/38/EC further amends Council Directive 76/115/EEC in relation to seat belt anchorages for motor vehicles. Directive 96/64/EC amends Council Directive 77/389/EEC in relation to motor vehicle towing devices. Directive 96/36/EC further amends Council Directive 77/541/EEC in relation to seat belts and restraint systems of motor vehicles. Directive 95/48/EC amends Council Directive 92/21/EEC in relation to masses and dimensions of category M1 motor vehicles. Directive 95/28/EC sets out requirements in relation to the burning behaviour of materials used in the interior construction of certain categories of motor vehicles. The directive provides that Member States may not refuse EEC type approval or national type approval for vehicles which have complied with the requirements. Directive 96/69/EC further amends Council Directive 70/220/EEC in relation to emissions from motor vehicles. Directive 96/1/EC amends Council Directive 88/77/EEC in relation to emissions from diesel engines for use in vehicles. Directive 96/27/EC provides that from 1st October 1998 Member States may no longer grant EC-type approval for motor vehicles which do not comply with requirements of the directive, in relation to the protection of occupants in the event of side impact resistance. From 1st October 2003 Member States must consider certificates of conformity which accompany new vehicles to be no longer valid if they do not certify that there has been compliance with the requirements.
