LOCAL GOVERNMENT, ENGLAND AND WALES

The Forest of Dean (Parishes and Electoral Changes) Order 1997

  Made 21st January 1997 
  Coming into force in accordance with article 1(2)

Whereas the Local Government Commission for England, acting pursuant to section 15(4) of the Local Government Act 1992[1], has submitted to the Secretary of State a report on its review of the county of Gloucestershire, together with its recommendations:

And whereas the Secretary of State has decided to give effect to the recommendations in respect of the boundary between the parishes of West Dean and Coleford in the district of Forest of Dean in that county and the electoral arrangements for the council of that district:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by sections 17[2] and 26 of the Local Government Act 1992, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement
     1 .  - (1) This Order may be cited as the Forest of Dean (Parishes and Electoral Changes) Order 1997.

    (2)

    (a) Articles 1 to 4 shall come into force on 1st April 1997 except that for the purpose of all proceedings preliminary or relating to any local government election to be held on or after 1st May 1997 those articles shall come into force on the day after the day on which this Order is made.

    (b) Article 5 shall come into force on 6th May 1999 except that for the purpose of all proceedings preliminary or relating to any local government election to be held on or after that date that article shall come into force on 10th October 1998.

Interpretation
    
2 .  - (1) In this Order - 

    any reference to an electoral division is a reference to an electoral division of the county of Gloucestershire;

    any reference to a district ward is a reference to a ward of the district of Forest of Dean; and

    any reference to a parish ward is a reference to a ward of the parish of West Dean.

    (3) For the purposes of any statutory instrument made under Part II of the Local Government Act 1992 (local government changes for England)[4], 1st April 1997 is specified as the reorganisation date.

Transfers from West Dean to Coleford
     3 .  - (1) The area marked A1 on each of the maps shall be transferred from the parish of West Dean and the Broadwell district ward to - 

    (2) The area marked A2 on each of the maps shall be transferred from the parish of West Dean, the Pillowell district ward and the West Dean electoral division to -

4 .  - (1) The area marked DW1 on map 1 shall be transferred from the Broadwell district ward, the Broadwell parish ward and the Coleford electoral division to - 

    (2) The area marked DW2 on map 2 shall be transferred from the Broadwell district ward, the Broadwell parish ward and the Coleford electoral division to - 

Changes in number of district councillors
    
5 . Column (3) of the Schedule to the District of the Forest of Dean (Electoral Arrangements) Order 1980[5] shall be amended as follows - 

    (a) in the entry in respect of the Bream district ward, for "2" substitute "3";

    (b) in the entry in respect of the Broadwell district ward, for "3" subsitute "2"; and

    (c) in the entry in respect of the Coleford district ward, for "3" substitute "5".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order makes changes to the boundary between the parishes of West Dean and Coleford in the district of Forest of Dean in the county of Gloucestershire and to the boundaries of parish and district wards and county electoral divisions. Provision is also made for changes in the number of councillors of the district council with effect from the ordinary elections in 1999.

A map forming part of this Note gives a general guide to the areas affected and the changes made. Prints of the maps described in article 2(1) may be inspected at all reasonable times at the offices of the Forest of Dean District Council, the Coleford Town Council, the West Dean Parish Council and at the offices of the Secretary of State for the Environment which, until the beginning of March 1997, are located at 2 Marsham Street, London SW1P 3EB and, thereafter, at 2nd Floor, Ashdown House, 123 Victoria Street, London SW1E 6DE.
