The Secretary of State, in exercise of the powers conferred on him by section 232(2) and (4) of the Housing Act 1996[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation and interpretation
1. - (1) This Order may be cited as the Housing Act 1996 (Commencement No.6 and Savings) Order 1997.
(2) In this Order "the commencement date" means 12th[a] February 1997.
Commencement and Savings
2. The following provisions of the Act shall come into force on the commencement date, subject to the savings in the Schedule to this Order -
- sections 124 to 128,
section 129(1), (2), (5) and (6),
sections 130 to 134,
sections 136 and 137,
section 138(1) to (3),
section 141(1),
sections 144 to 146, and
section 147 to the extent that it is not already in force.
The substitution of section 83 of Housing Act 1985 and the amendments to section 84 of and Schedule 2 to that Act[2] (repossession: secure tenancies) shall have no effect in a case where a notice under section 83 of that Act (notice of proceedings for possession or termination) has been served before the commencement date.

Article 2 of this Order brings into force on 12th[b] February 1997 the following provisions of the Housing Act 1996 -
sections 124 to 128, 129(1), (2), (5) and (6), 130 to 134, 136 to 137, 138(1) to (3) and 141(1) (introductory tenancies); and
sections 144 to 146 and, to the extent it is not already in force, section 147 (repossession, & c.: secure tenancies).
The amendments to Part IV of the Housing Act 1985 (secure tenancies) made by the provisions commenced in the Order are subject to the savings in the Schedule to the Order.
