LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Changes for England (Finance) (Amendment) Regulations 1996

    The Secretary of State, in exercise of the powers conferred upon him by sections 19 and 26 of the Local Government Act 1992[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations—
    Citation and commencement
        1.    These Regulations may be cited as the Local Government Changes for England (Finance) (Amendment) Regulations 1996 and shall come into force on 1st April 1996.
    Amendment of Finance Regulations
        2.    In regulation 54A of the Local Government Changes for England (Finance) Regulations 1994 (subsidy, contributions and financial assistance)[2]
       (a) for paragraph (2)(a) substitute—
          "(a) section 63 of the Rent Act 1977 (rent officer schemes)[3];
          (ab) section 429 of the Housing Act 1985 (the improvement for sale scheme)" ; and
       (b) at the end add—
        "  (4)  In this regulation "designated authority" includes an authority designated by a scheme made under section 63 of the Rent Act 1977 where the scheme takes effect on the reorganisation date."

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend regulation 54A of the Local Government Changes for England (Finance) Regulations 1994 to provide for the treatment of grants made by the Secretary of State under section 63 of the Rent Act 1977 (rent officer schemes) to an authority which is abolished under Part II of the Local Government Act 1992.
