CRIMINAL LAW, ENGLAND AND WALES CRIMINAL LAW, NORTHERN IRELAND

The Criminal Appeal Act 1995 (Commencement No. 3) Order 1996

Made 16th December 1996

    In exercise of the powers conferred on him by section 32 of the Criminal Appeal Act 1995[1] the Secretary of State hereby makes the following Order:
        1.    This Order may be cited as the Criminal Appeal Act 1995 (Commencement No. 3) Order 1996.
        2.    In this Order "the 1995 Act" means the Criminal Appeal Act 1995.
        3.    Section 8 of and paragraphs 1 and 2 of Schedule 1 to the 1995 Act, for the purposes for which they are not already in force[2], and section 31(1)(a) of and paragraphs 3 to 11 of Schedule 1 and paragraphs 7 to 11 of Schedule 2 to the 1995 Act shall come into force on 1 January 1997.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings fully into force on 1 January 1997 section 8 of and Schedule 1 and paragraphs in Schedule 2 to the Criminal Appeal Act 1995. (Section 8 and paragraphs 1 and 2 of Schedule 1 came into force on 12 ecember 1996 for the purposes of making recommendations and appointments under that section and paragraph 1 of that Schedule, see the Criminal Appeal Act 1995 (Commencement No. 2) Order 1996 (S.I. 1996/3041)).
    These provisions relate to the Criminal Cases Review Commission, the body established under section 8 of that Act to consider claims of miscarriages of justice.
