EDUCATION, ENGLAND AND WALES

The Berkshire College of Art and Design, Maidenhead (Dissolution) Order 1996

Made 10th December 1996
Laid before Parliament 16th December 1996
Coming into force 6th January 1997

    Whereas the Secretary of State for Education and Employment has received a proposal from the Further Education Funding Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992[1] ("the Act"), for the dissolution under section 27 of the Act of the further education corporation known as Berkshire College of Art and Design, Maidenhead[2] ("the Transferor");Now therefore in exercise of the power conferred on her by section 27 of the Act the Secretary of State after consulting the Transferor and with the consent of the further education corporation known as Reading College of Arts and Technology[3] ("the Transferee") hereby makes the following Order:
        1.    This Order may be cited as The Berkshire College of Art and Design, Maidenhead (Dissolution) Order 1996 and shall come into force on 6th January 1997.
        2.    On 6th January 1997 the Transferor shall be dissolved and all of its property, rights and liabilities shall be transferred to the Transferee, being a body corporate established for purposes which include the provision of educational facilities or services.
        3.    Section 26(2), (3) and (4) of the Act shall apply to any person employed by the Transferor before 6th January 1997 as if the references in that section—
       (a) to a person to whom that section applies were to a person so employed;
       (b) to the operative date were to 6th January 1997;
       (c) to the transferor were to the Transferor within the meaning of this Order; and
       (d) to the corporation were to the Transferee.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order dissolves the further education corporation established to conduct Berkshire College of Art and Design, Maidenhead. It provides that the property, rights and liabilities of that College transfer to Reading College of Arts and Technology and secures the rights of its employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
