The Code of Practice on Environmental Procedures for Flood Defence Operating Authorities (Environment Agency) Approval Order 1996

Laid before Parliament 5th December 1996
Coming into force 1st January 1997

    The Minister of Agriculture, Fisheries and Food and the Secretary of State for Wales, ("the Ministers"), in exercise of the powers conferred on them[1] by section 9(1) and 56(3) of the Environment Act 1995[2] and after consulting in accordance with section 9(3) of that Act hereby jointly make the following Order:
    Title and commencement
        1.    This Order may be cited as the Code of Practice on Environmental Procedures for Flood Defence Operating Authorities (Environment Agency) Approval Order 1996 and shall come into force on 1st January 1997.
    Approval of Code of Practice
        2.    The Ministers approve the code of practice issued by them entitled "Code of Practice on Environmental Procedures for Flood Defence Operating Authorities"[3] for the purpose of —
       (a) giving practical guidance to the Environment Agency with respect to the matters for the purposes of which section 6(1), 7 and 8 of the Environment Act 1995 have effect; and
       (b) promoting what appear to them to be desirable practices by the Environment Agency with respect to those matters.

    By this order, the Secretary of State and the Minister of Agriculture, Fisheries and Food approve, in accordance with section 9 of the Environment Act 1995, the "Code of Practice on Environmental Procedures for Flood Defence Operating Authorities" issued by them.
