TRADE DESCRIPTIONS

The Trade Descriptions (Place of Production) (Marking) (Revocation) Order 1996

Coming into force 9th December 1996

    Whereas the Secretary of State for Trade and Industry has, in accordance with section 38(3)(a) of the Trade Descriptions Act 1968[1], consulted with such organisations as appear to him to be representative of interests substantially affected by this Order:
    And whereas the Secretary of State for Trade and Industry, in accordance with the same section, published on 21 June 1996 notice of his intention to make the Order and of the place where copies of the proposed Order might be obtained;
    Now, therefore, the Secretary of State for Trade and Industry, jointly with the Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Northern Ireland, in exercise of the powers conferred by section 8 of that Act (and now vested in the Secretary of State)[2] and section 38(1) and (2) of that Act and of all other powers enabling them in that behalf, hereby make the following Order: —
        1.    This Order may be cited as the Trade Descriptions (Place of Production) (Marking) (Revocation) Order 1996 and shall come into force on 9th December 1996.
        2.    The Trade Descriptions (Place of Production) (Marking) Order 1988[3] is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order revokes the Trade Descriptions (Place of Production) (Marking) Order 1988.
    That Order required certain goods, when supplied or exposed or offered for supply in the course of a trade or business and presented in such a way as to give a misleading indication of their place of manufacture or production, to be marked with or accompanied by a corrective statement of their actual place of manufacture or production.
    The 1988 Order was textually amended by the Marketing Authorisations for Veterinary Medicinal Products Regulations 1994 (S.I. 1994/3142) and The Medicines for Human Use (Marketing Authorisations Etc.) Regulations 1994 (S.I. 1994/3144), so as to exclude articles or substances to which those Regulations apply from the scope of the 1988 Order. Those Regulations were made under section 2(2) European Communities Act 1972 and implement and supplement various European Community instruments relating, respectively, to the marketing of veterinary products and medicinal products for human use.
