The Dairy Produce Quotas (Amendment) Regulations 1996

    The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting jointly, in the exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:—
    Title and commencement
        1.    These Regulations may be cited as the Dairy Produce Quotas (Amendment) Regulations 1996 and shall come into force on 7th November 1996.
    Amendment of the Dairy Produce Quotas Regulations 1994
        2.—(1)  The Dairy Produce Quotas Regulations 1994[3] shall be amended in accordance with paragraph (2) below.

        (2)  In regulation 15 (temporary transfer of quota), for paragraph (3A) there shall be substituted the following paragraph:
      "  (3A)  In the quota year commencing on 1st April 1996, the notice described in paragraph (3) shall be submitted to the Intervention Board no later than 31st December 1996." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Dairy Produce Quotas Regulations 1994 ("the principal Regulations").
    Regulation 2 amends regulation 15 of the principal Regulations so that, as regards the quota year commencing on 1st April 1996, the date by which a transferee of quota must notify the Intervention Board of an agreement made for the temporary transfer of quota in accordance with that regulation is extended to 31st December 1996, which is the latest notification date permitted under Article 6 of Council Regulation (EEC) No. 3950/92 establishing an additional levy in the milk and milk products sector (OJ No. L405, 31.12.92, p.1).
    The expressions "quota", "quota year", and "transferee" are defined in regulation 2(1) of the principal Regulations.
