MERCHANT SHIPPING

The Merchant Shipping (Fees) (Amendment) Regulations 1996

Laid before Parliament 21st October 1996
Coming into force 1st November 1996

    The Secretary of State for Transport in exercise of the powers conferred by section 302(1) of the Merchant Shipping Act 1995[1] and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Merchant Shipping (Fees) (Amendment) Regulations 1996 and shall come into force on 1st November 1996.
    Amendment of Regulations
        2.—(1)  The Merchant Shipping (Fees) Regulations 1995[2] shall be amended as follows.

        (2)  In regulation 4(1)(f) the words "to British Telecommunications plc" shall be omitted.

        (3)  In Schedule 1, Part 1—
       (a) in the table in paragraph 1(2)—
         (i) in section F in the column `Amended by S.I.', for the entry `Fishing Vessels (Safety Provisions) Rules 1975 there shall be inserted "1996/2419".
         (ii) section H shall be omitted.
         (iii) in section K for the title and number—
          Merchant Shipping (Prevention of Oil Pollution) Regulations 1983 1398 1985/2040 1992/98 1993/1680 1994/2085
          Merchant Shipping (Prevention of Oil Pollution) Regulations 199 2154
         (iv) in section M in the column "Amended by S.I.", for the entry in the section there shall be inserted "1996/2418".
       (b) in paragraph 2(2)—
         (i) the words "by British Telecommunications plc" shall be omitted;
         (ii) in sub-paragraph (a) for "£50" there shall be substituted the words "£23 for fishing vessels and £26 for other ships";
         (iii) in sub-paragraph (b) for the words "£82 for fishing vessels, and £100 for other ships" there shall be substituted "£32".
       (c) in paragraph 4(6)—
         (i) the words "by British Telecommunications plc" where they first appear shall be omitted;
         (ii) for the words "British Telecommunications plc" where they appear for the second time there shall be substituted the words "the appropriate Certifying Authority (within the meaning of those Rules)".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Merchant Shipping (Fees) Regulations 1995 (the "principal Regulations").
    The fees charged for services performed pursuant to the Radio Rules (as defined in the principal Regulations) are reduced to £23 per hour for fishing vessels and £26 per hour for other ships in respect of time occupied by the survey and to £32 in respect of all administrative and other work for all vessels (Regulation 2(3)). The previous fees were £50 per hour in respect of time occupied by the survey for all ships and £82 and £100 for all other administrative and other work for fishing vessels and other ships respectively. The references to British Telecommunica tions in relation to fees charged in connection with services performed pursuant to the Radio Rules are removed.
    These Regulations also amend the table of statutory instruments in Schedule 1, Part 1 to the principal Regulations.
