The National Park Authorities (England) (Amendment) Order 1996

Coming into force 6th November 1996

    The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 63(1) and (2) and 75 of the Environment Act 1995[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the National Park Authorities (England) (Amendment) Order 1996 and shall come into force on 6th November 1996.
    Amendment of Order
        2.    Paragraph 10 (standing orders) of Schedule 7 (transitional provisions: general) of the National Park Authorities (England) Order 1996[2] is amended by the substitution, for sub-paragraph (2), of the following—
      "  (2)  On and after 1st April 1997, paragraphs 1 and 2 of Part I, and paragraph 3(a) of Part II, of the Schedule to the Local Authorities (Standing Orders) Regulations 1993 shall apply to a National Park authority and, accordingly, a National Park authority shall, not later than its first meeting after that date, take all the action required by regulations 2 and 4 of those Regulations in respect of the standing orders provided for in those paragraphs." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations correct an error in paragraph 10 of Schedule 7 to the National Park Authorities (England) Order 1996. The substituted sub-paragraph (2) provides for the application of provisions of the Local Authorities (Standing Orders) Regulations 1993 on 1st April 1997 (at the end of the transitional period following the establishment of National Park authorities in England on 1st October 1996), rather than, as the original sub-paragraph provided, the non-application of those provisions. (The 1993 Regulations are applied to National Park authorities as mentioned in paragraph 5 of Schedule 5 to the 1996 Order.
