ENTERPRISE ZONES

The Tyne Riverside Enterprise Zones (North Tyneside and South Tyneside) (Designation) Order 1996

Made 19th September 1996
Laid before Parliament 27th September 1996
Coming into force 21st October 1996

    Whereas the Tyne and Wear Development Corporation[1], acting pursuant to Schedule 32 to the Local Government, Planning and Land Act 1980[2] ("the Schedule"), on 26th February 1996 by resolution adopted the following enterprise zone schemes—
    the Tyne Riverside Enterprise Zone No. 8: Baltic Enterprise Park Scheme;
    the Tyne Riverside Zone No. 9: Viking Industrial Park—Wagonway West Scheme;
    the Tyne Riverside Enterprise Zone No. 10: Viking Industrial Park—Blackett Street Scheme; and
    the Tyne Riverside Enterprise Zone No. 11: Viking Industrial Park—Western Road Scheme:
    And whereas that Corporation subsequently published, in accordance with paragraphs 3(4)(c) and (8) of the Schedule, an advertisement relating to those Schemes and complying with paragraph 3(7) of the Schedule in The Journal (a newspaper circulating in the area to which the Schemes relate) and in the London Gazette;
    And whereas a period of six weeks has, for the purposes of paragraph 5(2)(a) of the Schedule, expired since the first publication of that advertisement on 1st March 1996, and no application has been made to the High Court under paragraph 4 of the Schedule in respect of any of the Schemes:
    Now therefore the Secretary of State for the Environment, in exercise of the powers conferred on him by paragraph 5 of the Schedule and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Order:—
    Citation and commencement
        1.    This Order may be cited as the Tyne Riverside Enterprise Zones (North Tyneside and South Tyneside) (Designation) Order 1996 and shall come into force on 21st October 1996.
    Interpretation
        2.    In this Order:
      "the Corporation" means the Tyne and Wear Development Corporation;
      "map" means a map prepared in duplicate, numbered, marked "Map referred to in the Tyne Riverside Enterprise Zones (North Tyneside and South Tyneside) (Designation) Order 1996", and signed by an Under Secretary in the Department of the Environment, one duplicate of which has been deposited and is available for inspection at the principal offices of the Corporation, and the other at the offices of the Secretary of State for the Environment.

    Enterprise zones in North Tyneside and South Tyneside (Tyne and Wear urban development area)
        3.—(1)  In this article, "zone area" means an area—
       (a) to which a Scheme listed in column 1 below relates; and
       (b) the boundaries of which are represented by the outside edge of a black line edged internally with a stippled band on the map bearing the number specified in relation to that Scheme in column 2.

        (2)  Each zone area is hereby designated as an enterprise zone, and the Corporation is hereby designated as the enterprise zone authority for that zone.
    Period of designation
        4.    Designation under this Order shall take effect on 21st October 1996, and each designated area shall remain an enterprise zone for a period of 10 years from that date.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order designates as enterprise zones four areas, three of which are located within the metropolitan borough of South Tyneside, and one of which is located in the metropolitan borough of North Tyneside. The designated areas are the subject of the four enterprise zone schemes adopted by the Tyne and Wear Development Corporation (the urban development corporation for the Tyne and Wear urban development area). Three of the schemes relate to the Viking Industrial Park, and the remaining one to the Baltic Enterprise Park.
    The designations are effective for a period of 10 years.
    The location and area of the enterprise zones are shown on the plans forming part of this note. The four detailed maps referred to in articles 2 and 3(1)(b) may be inspected at the principal offices of the Tyne and Wear Development Corporation, and at the offices of the Secretary of State for the Environment.
