EDUCATION, ENGLAND AND WALES

The Education (Grant-maintained Special Schools) (Amendment) (No. 2) Regulations 1996

Made 3rd September 1996
Laid before Parliament 6th September 1996
Coming into force 27th September 1996

    In exercise of the powers conferred on the Secretary of State by sections 186 and 301(6) of the Education Act 1993[1], the Secretary of State for Education and Employment, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Education (Grant-maintained Special Schools) (Amendment) (No. 2) Regulations 1996 and shall come into force on 27th September 1996.
    Amendment
        2.    For regulation 20(6) (modification of section 273(6) of the Education Act 1993) of the Education (Grant-maintained Special Schools) Regulations 1994[2] there shall be substituted the following paragraph:
      "  (6)  For subsection (6) there shall be substituted—
        "  (6)  If in any case where subsection (5) above applies proposals under section183(2)(b) are approved, the proposals shall be treated for the purposes of Part III of this Act as if they were proposals under section 183(4) of this Act in respect of which notice had been served under section 183(6) of this Act and the proposals had been approved under section 184(4) of this Act; and section 185 of this Act shall apply accordingly."

        3.    Regulation 17 (joint schemes) of the Education (Grant-maintained Special Schools) Regulations 1994 is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend regulation 20 of the Education (Grant-maintained Special Schools) Regulations 1994 which applies section 273 of the Education Act 1993 (the power to make and deal with proposals for the alteration and discontinuance of schools eligible for grant-maintained status) to maintained special schools.
    These Regulations also revoke regulations 17 of the Education (Grant-maintained Special Schools) Regulations 1994 which provided for grant-maintained special schools to enter into joint schemes.
