PLANT HEALTH

The Plant Health (Fees) (Forestry) (Great Britain) Regulations 1996

Made 4th September 1996
Laid before Parliament 10th September 1996
Coming into force 1st October 1996

    The Forestry Commissioners, being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to the common agricultural policy of the European Community in respect of forestry, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:
    Title, commencement, extent and interpretation
        1.—(1)  These Regulations may be cited as the Plant Health (Fees) (Forestry) (Great Britain) Regulations 1996 and shall come into force on 1st October 1996.

        (2)  These Regulations extend to Great Britain.

        (3)  In these Regulations—
      "authority" means an authority to issue plant passports under article 17 of the Plant Health (Forestry) (Great Britain) Order 1993[3];
      "licence" means a licence under article 28 or 28A of the Plant Health (Forestry) (Great Britain) Order 1993.

    Fees
        2.    There shall be paid to the Forestry Commissioners—
       (a) in respect of each service of the type described in column 1 of Schedule 1 to these Regulations the fee prescribed in column 2 of that Schedule in relation to that service;
       (b) in respect of each service of a type described in column 2 of Schedule 2 to these Regulations the fee prescribed in column 3 of that Schedule in relation to that service.
    Revocations
        3.    The Import and Export (Plant Health Fees) (Forestry) (Great Britain) Order 1990[4] and the Import and Export (Plant Health Fees) (Forestry) (Great Britain) (Amendment) Order 1991[5] are hereby revoked.
