LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Changes For England (Direct Labour and Service Organisations) (Amendment) Regulations 1996

    The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 19 and 26 of the Local Government Act 1992[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Local Government Changes for England (Direct Labour and Service Organisations) (Amendment) Regulations 1996 and shall come into force on 12th August 1996.

        (2)  In these Regulations—
      "the 1994 Regulations" means the Local Government Changes for England (Direct Labour and Service Organisations) Regulations 1994[2];

      "the 1992 Act", "order", "order date" and "relevant authority" have the same meanings as in the 1994 Regulations; and

      "relevant direction" means a direction given under section 13 of the 1992 Act (duty to conduct reviews and make recommendations) on or after 17 May 1995.

    Amendment of 1994 Regulations
        2.—(1)  In regulation 2 of the 1994 Regulations (interpretation), in the definition of "relevant order", for "17th May 1995" substitute "12th August 1996".

        (2)  Where an order giving effect to recommendations made by the Local Government Commission in pursuance of a relevant direction is made before 12th August 1996, the 1994 Regulations shall have effect, in relation to a relevant authority, as if any reference to the order date were a reference to 12th August 1996.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Local Government Changes for England (Direct Labour and Service Organisations) Regulations 1994 which make provision for the application of the competition provisions of Part III of the Local Government, Planning and Land Act 1980 and Part I of the Local Government Act 1988 in relation to authorities ("relevant authorities") affected by orders made under section 17 of the Local Government Act 1992. The relevant orders are those implementing recommendations made to the Secretary of State by the Local Government Commission for England pursuant to directions given to that Commission under section 13 of the Act of 1992.
    Regulation 2(1) amends the definition of "relevant order" in the Regulations of 1994 by substituting 12th August 1996 for 17th May 1995 as the date before which directions should have been given for authorities to fall within the description of relevant authorities.
    Regulation 2(2) makes transitional provision in respect of orders made before 12th August 1996 which implement recommendations made pursuant to directions given on or after 17th May 1995.
