HARBOURS, DOCKS, PIERS AND FERRIES

The Aberystwyth Harbour Revision Order 1995

Made 18th December 1995
Coming into force 19th December 1995

    Whereas the making of this Order is not opposed;
    Now therefore, the Secretary of State for Wales (being the appropriate Minister under subsection (7) of section 14 of the Harbours Act 1964[1]) in exercise of the powers conferred by that section and now vested in him[2], and of all other powers enabling him in that behalf, and on the application of Cyngor Dosbarth Ceredigion, being the harbour authority engaged in improving, maintaining and managing the harbour of Aberystwyth, and those trading as IMP Developments, appearing to have a substantial interest for the purposes of section 14(2)(a) of the said Act, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Aberystwyth Harbour Revision Order 1995 and shall come into force on 19th December 1995.
    Amendment of the Aberystwyth Harbour Act 1987
        2.    For subsections (4) and (5) of section 5 (Power to construct works) of the Aberystwyth Harbour Act 1987[3] there shall be substituted the following subsections:
      "  (4)  The Council may, in relation to the works, form and lay out a means of access at the point marked "A" on the deposited plan for purposes of the construction of the works and thereafter for the general purposes of the harbour undertaking.

          (5)  The Council shall not commence the construction of any part of the works other than the means of access at the point marked "A" on the deposited plan until that means of access has been completed to the reasonable satisfaction of the Secretary of State."

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends subsections (4) and (5) of section 5 (Power to construct works) of the Aberystwyth Harbour Act 1987 so as to provide for only one means of access to the development authorised by that Act.
    The applicants for the Order are Cyngor Dosbarth Ceredigion and those trading as IMP Developments, who are Meirion Ellis Jones, Ian Alexander Jones and Ifan Prys Edwards all of Glanyrafon Industrial Estate, Llanbadarn Fawr, Aberystwyth, Dyfed.
