LOCAL GOVERNMENT, SCOTLAND

The Local Authorities (Discretionary Expenditure) (Scotland) Regulations 1996

Made 6th March 1996
Laid before Parliament 11th March 1996
Coming into force 1st April 1996

    The Secretary of State, in exercise of the powers conferred on him by section 83(4AA) of the Local Government (Scotland) Act 1973[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Local Authorities (Discretionary Expenditure) (Scotland) Regulations 1996 and shall come into force on 1st April 1996.
    Determination of relevant population
        2.    For the purposes of section 83(4)(b) of the Local Government (Scotland) Act 1973[2], the relevant population of the area of a local authority in relation to a financial year ("the relevant year") shall be the resident population of that area in the financial year beginning two years before the relevant year, as estimated by the Registrar General of Births, Deaths and Marriages for Scotland before the beginning of the relevant year.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    The annual limit on the amount of expenditure which a Scottish local authority may incur for purposes not otherwise authorised is, with effect from 1st April 1996, determined under section 83(4) of the Local Government (Scotland) Act 1973 by multiplying £3.80 by the relevant population of the authority's area. These Regulations make provision as to how the relevant population is to be calculated for these purposes.
