The Carriage by Air (Sterling Equivalents) Order 1996

Made 6th February 1996
Coming into force 29th February 1996

    The Secretary of State for Transport, in exercise of the powers conferred by section 4(4) of the Carriage by Air Act 1961[1] and by that provision as applied by article 6 of the Carriage by Air Acts (Application of Provisions) Order 1967[2] and now vested in him[3] and of all other powers enabling him in that behalf, hereby makes the following Order:—
        1.    This Order may be cited as the Carriage by Air (Sterling Equivalents) Order 1996 and shall come into force on 29th February 1996.
        2.    The Carriage by Air (Sterling Equivalents) Order 1986[4] is hereby revoked.
        3.    The amounts shown in column 2 of the following Table are hereby specified as amounts to be taken, for the purposes of article 22 in the First Schedule to the Carriage by Air Act 1961 and that article as applied by article 5 of the Carriage by Air Acts (Application of Provisions) Order 1967 as equivalent to the sums respectively expressed in francs in column 1 of that Table:

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order specifies the sterling equivalents of amounts, expressed in gold francs as the limit of the air carrier's liability under the Warsaw Convention of 1929, and under that Convention as amended by the Hague Protocol of 1955, as well as under corresponding provisions applying to international carriage by air to which the Convention and Protocol do not apply. It supersedes the Carriage by Air (Sterling Equivalents) Order 1986.
    The sterling equivalents have been calculated by reference to the Special Drawing Right (SDR) value of a gold franc converted into sterling at the average market rate for the month ending 25th January 1996. The new sterling figures are approximately 16.53 per cent greater than those in the superseded Order. The SDR is based on a basket of 5 major world currencies.
