The Farm and Conservation Grant (Variation) Scheme 1996

    The Minister of Agriculture, Fisheries and Food and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 28 and 29 of the Agriculture Act 1970[1], and of all other powers enabling them in that behalf, with the approval of the Treasury, hereby make the following Scheme:
    Title, commencement and extent
        1.—(1)  This Scheme may be cited as the Farm and Conservation Grant (Variation) Scheme 1996 and shall come into force on 19th February 1996.

        (2)  This Scheme shall apply to England and Wales.
    Variation of the principal Scheme
        2.    The Farm and Conservation Grant Scheme 1989[2] shall be further varied in accordance with paragraphs 3 and 4 below.
        3.    In paragraph 7(1) (closing dates for claims and incurring certain expenditure), after the words "subject to", there shall be inserted the words "paragraphs (1A) and".
        4.    After paragraph 7(1) there shall be inserted the following sub-paragraphs:—
      "  (1A)  Subject to paragraphs (1B) and (2) below, the appropriate Minister shall not, in relation to an agricultural business in Wales, pay any grant under this Scheme unless the claim for grant is received by him on or before 18th February 1998.

          (1B)  Sub-paragraph (1A) above shall not apply to a claim for grant made in relation to any work, facility or transaction of a kind specified in paragraph 1(b) or (c) in column 1 of Schedule 1." .

EXPLANATORY NOTE

(This note is not part of the Scheme)
    This Scheme further varies the Farm and Conservation Grant Scheme 1989 by providing that in relation to an agricultural business in Wales a claim for grant must be received on or before 18th February 1998. That closing date does not, however, apply to claims for grant in respect of facilities for the handling, storage and treatment of agricultural effluents and waste and related fixed disposal facilities or in respect of poultry manure stores. Such claims must be received on or before 19th February 1996 (paragraphs 2 to 4).
