LOCAL GOVERNMENT, ENGLAND AND WALES

Local Government Act 1988 (Defined Activities) (Specified Periods) (England) (Amendment) Regulations 1995

Coming into force 1st January 1996

    The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 8(1) and 15(6) of the Local Government Act 1988[1] and all other powers enabling him in that behalf hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Specified Periods) (England) (Amendment) Regulations 1995 and shall come into force on 1st January 1996.
    Amendment of Regulations
        2.    The Local Government Act 1988 (Defined Activities) (Specified Periods) (England) Regulations 1995[2] ("the Regulations") shall be amended as follows—
       (a) In regulation 3 (application), omit the words "including a statement of the period during which the work is to be carried out"; and
       (b) in regulation 4 (disapplication of previous regulations) insert the words "regulation 3 of" before the words "the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1990".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations are made to correct errors in the Local Government Act 1988 (Defined Activities) (Specified Periods) (England) Regulations 1995 ("the Regulations") and are being issued free of charge to all known recipients of those Regulations.
    Regulation 3 of the 1995 Regulations provides that those Regulations do not apply to work for which a notice including a statement of the period during which the work is to be carried out has been published in accordance with the requirements of the Local Government Act 1988 on or before 19th October 1995. These Regulations amend regulation 3 to omit the reference to the statement of the period during which the work is to be carried out.
    Regulation 4 of the 1995 Regulations disapplies certain specified regulations to the work to which the 1995 Regulations apply. These Regulations amend the list of regulations which do not apply to this work.
