PENSIONS

The Pensions Act 1995 (Commencement No. 2) Order 1995

Made 30th November 1995

    The Secretary of State for Social Security, in exercise of the powers conferred on him by section 180(1) of the Pensions Act 1995[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and interpretation
        1.—(1)  This Order may be cited as the Pensions Act 1995 (Commencement No. 2) Order 1995.

        (2)  In this Order references to sections and Schedules are references to sections of, and Schedules to, the Pensions Act 1995.
    Appointed day
        2.—(1)  The day appointed for the coming into force of section 39 (exercise of powers by member trustees), and sections 117, 121 and 124, insofar as they relate to that section, is 1st January 1996.

        (2)  The day appointed for the coming into force of sections 62 to 66 (equal treatment) and sections 117, 120, 121, 124, 174 and 175 insofar as they relate to those sections—
       (a) for the purpose only of authorising the making of regulations under sections 63(5), 64(2) and (3) and 66(4), is 4th December 1995; and
       (b) for all other purposes, is 1st January 1996.

        (3)  The day appointed for the coming into force of paragraphs 29, 32 to 37, 39(b), 42, 44(a)(i) and 47 of Schedule 3 (repeal of section 118 of the Pension Schemes Act 1993[2]: equal access), and section 122 insofar as it relates to these paragraphs, is 1st January 1996.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides for the coming into force of provisions of the Pensions Act 1995 on the following dates—
      — 1st January 1996 for section 39 concerning the exercise of powers by member trustees;

      — 1st January 1996 for the full coming into force of sections 62 to 66 and paragraphs 29, 32 to 37, 39(b), 42, 44(a)(i) and 47 of Schedule 3 concerning equal treatment and 4th December 1995 for the coming into force of sections 62 to 66 for the purposes of making regulations in relation thereto.
