LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Sports and Leisure Management, Cleaning of Buildings and Repair and Maintenance of Vehicles) (Exemption) Order 1995

Laid before Parliament 2nd November 1995
Coming into force 23rd November 1995

    The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Local Government Act 1988 (Sports and Leisure Management, Cleaning of Buildings and Repair and Maintenance of Vehicles) (Exemption) Order 1995 and shall come into force on 23rd November 1995.
    Exemption of sports and leisure management
        2.    The management of sports and leisure facilities by the Peterborough City Council, the Croydon London Borough Council and the Tower Hamlets London Borough Council shall not be treated as a defined activity so long as it is undertaken—
       (a) in the case of the Peterborough City Council, at the Lido, Bishops Road, Peterborough, before 1st April 1997;
       (b) in the case of the Croydon London Borough Council, at the Water Palace, Purley Way, Croydon, before 1st September 1996;
       (c) in the case of the Tower Hamlets London Borough Council at-
         (i) York Hall, Old Ford Road, during the period beginning on 1st January 1996 and ending with 31st December 1996;
         (ii) the Mile End Stadium, Rhodeswell Road and the Langdon Park Sports and Community Centre, 7 Byron Street, during the period beginning on 1st April 1996 and ending with 31st December 1996.
    Exemption of cleaning of buildings
        3.    The cleaning of buildings by the Harrow London Borough Council shall not be treated as a defined activity so long as it is undertaken at any of the sites listed in the Schedule to this Order before 1st April 1996.
    Exemption of repair and maintenance of vehicles
        4.—(1)  The repair and maintenance of vehicles by the Sutton London Borough Council and the joint committee shall not be treated as a defined activity so long as it is undertaken in respect of a relevant vehicle and—
       (a) in the case of the Sutton London Borough Council, before 1st July 1996;
       (b) in the case of the joint committee, before 1st January 1996.

        (2)  In this article—
      "the joint committee" means the joint committee of the councils of the boroughs of Bradford, Calderdale, Kirklees, Leeds and Wakefield established on 1st April 1986 to discharge waste management functions in the area of the county of West Yorkshire; and

      "relevant vehicle" means a vehicle used by the Sutton London Borough Council or the joint committee, as the case may be, in connection with any of their functions.
