ENVIRONMENTAL PROTECTION

The Environment Act 1995 (Commencement No.2) Order 1995

Made 5th October 1995

    The Secretary of State, in exercise of the powers conferred on him by section 125(3) of the Environment Act 1995[1], hereby makes the following Order:
    Citation
        1.    This Order may be cited as the Environment Act 1995 (Commencement No.2) Order 1995.
    Provisions coming into force on 12th October 1995
        2.    The following provisions of the Environment Act 1995 shall come into force on 12th October 1995:—
       (a) section 20 (the Scottish Environment Protection Agency);
       (b) section 21 (transfer of functions to SEPA);
       (c) section 22 (transfer of property, rights and liabilities to SEPA);
       (d) section 23 (functions of staff commission);
       (e) section 30 (records held by SEPA);
       (f) section 31 (guidance on sustainable development and other aims and objectives);
       (g) section 32 (general environmental and recreational duties);
       (h) section 36 (codes of practice with respect to environmental and recreational duties);
       (i) section 59 (abandoned mines; Scotland), in so far as the amendments made by that section confer power on the Secretary of State to make regulations; and
       (j) section 120(1) (minor and consequential amendments), in so far as it relates to the following provisions of Schedule 22:—
         (i) paragraph 15;
         (ii) sub-paragraphs (1) and (22) of paragraph 29, in so far as the amendments made by those provisions confer power on the Secretary of State to make regulations;
         (iii) sub-paragraphs (1) to (3) and (5) of paragraph 51; and
         (iv) paragraph 53.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 12th October 1995 certain provisions of the Environment Act 1995. The provisions in question are listed at article 2 and are principally concerned with, or related to, the establishment of the Scottish Environment Protection Agency.



NOTE AS TO EARLIER COMMENCEMENT ORDERS

    The following provisions of the Environment Act 1995 are brought into force by the Environment Act 1995 (Commencement No.1) Order 1995 (S.I. 1995/1983):—

    Sections 1, 3(2) to (8), 4, 7, 9, 12, 37(1), (2) and (9), 38 to 40, 43 to 52, 56, 120(1) (partially), 120(4) to (6), and 121 to 124. 28th July 1995
    Sections 41 (partially), 42, 57 and 58 (both partially), 93 to 95, 97 to 103 and 105, 116 and 120(1) and (3) (all partially). 21st January 1995
    Sections 105 and 120(2) and (3) (all partially) 1st January 1999
