The Motor Vehicles (EC Type Approval) (Amendment) Regulations 1995

    The Secretary of State for Transport, being a Minister designated[1] for the purposes of subsection (2) of section 2 of the European Communities Act 1972[2] in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment) Regulations 1995 and shall come into force on 1st October 1995.
        2.—(1)  Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 1992[3] shall be amended as follows.

        (2)  For item 33 there shall be substituted the following item—
    33 78/316/EEC L81,, 28.3.78,, p.3 Identification of controls
    93/91/EEC* L284,, 19.11.93,, p.25
    94/53/EC* L299,, 22.11.94,, p.26,.


        (3)  For item 35 there shall be substituted the following item—

        (4)  For item 37 there shall be substituted the following item—

        (5)  In the second column of item 39 for "93/116/EEC*" there shall be substituted "93/116/EC*".

        (6)  For item 46 there shall be substituted the following item—

EXPLANATORY NOTE

(This note is not part of the Regulations)

    These Regulations amend Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 1992 and are made in consequence of Commission Directives 94/53/EC, 94/68/EC, 94/78/EC and Directive 94/20/EC which was made by the European Parliament and the Council. These Regulations also correct an error in item 39 of Schedule 1.
    Directive 94/53/EC further amends Council Directive 78/316/EEC relating to the interior fittings of motor vehicles (identification of controls, tell-tales and indicators).
    Directive 94/68/EC amends Council Directive 78/318/EEC relating to the wiper and washer systems of motor vehicles.
    Directive 94/78/EC amends Council Directive 78/549/EEC relating to the wheel guards of motor vehicles.
    Directive 94/20/EC relates to mechanical coupling devices of motor vehicles and their trailers and their attachment to those vehicles.
    Copies of EEC and EC Directives which are relevant to these Regulations can be obtained from Her Majesty's Stationery Office. The details of the Directives are set out below.
