ENVIRONMENTAL PROTECTION

The Repeal of Offensive Trades or Businesses Provisions Order 1995

Made 31st July 1995
Laid before Parliament 11th August 1995
Coming into force 1st September 1995

    The Secretary of State, considering it expedient, having regard to the operation of Part I and Part III of the Environmental Protection Act 1990[1] in relation to offensive trades or businesses, in exercise of his poers under section 84(4) of that Act, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Repeal of Offensive Trades or Businesses Provisions Order 1995 and shall come into force on 1st September 1995.
    Repeal of Offensive Trades or Businesses Provisions
        2.    Sections 107 and 108 of the Public Health Act 1936[2] (offensive trades or businesses) are hereby repealed.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order repeals sections 107 and 108 of the Public Health Act 1936, which made provisions as to the establishment and carrying on of offensive trades opr businesses carried on within local authorities' districts. These activities are now regulated under Part I and Part III of the Environmental Protection Act 1990.
