The Army, Air Force and Naval Discipline Acts (Continuation) Order 1995

Made 26th July 1995

At the Court at Buckingham Palace, the 26th day of July 1995

The Queen's Most Excellent Majesty in Council

    Whereas a draft of this Order has been laid before Parliament and approved by a resolution of each House of Parliament:
    Now, therefore, Her Majesty, in pursuance of section 1(2) of the Armed Forces Act 1991[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
        1.    The Army Act 1955[2], the Air Force Act 1955[3] and the Naval Discipline Act 1957[4] shall continue in force for a period of twelve months beginning on the date immediately following 31st August 1995 (which is the date on which those Acts would otherwise expire).
        2.    This Order may be cited as the Army, Air Force and Naval Discipline Acts (Continuation) Order 1995.

EXPLANATORY NOTE

(This note is not part of the Order)
    Section 1(1) of the Armed Forces Act 1991 provides that the Army Act 1955, the Air Force Act 1955 and the Naval Discipline Act 1957 should continue in force until 31st August 1992 and should then expire unless continued in force in accordance with the section. The Army, Air Force and Naval Discipline Acts (Continuation) Orders 1992, 1993 and 1994 (S.I. 1992/1712, S.I. 1993/1804 and S.I. 1994/1903 respectively) have each provided for the continuation of the Acts for a period of 12 months. Under the 1994 Order, the Acts will continue in force until 31st August 1995.
    This Order enables the Army Act 1955, the Air Force Act 1955 and the Naval Discipline Act 1957 to continue in force for a period of 12 months beyond 31st August 1995.
