DEREGULATION

The Deregulation and Contracting Out Act 1994 (Commencement No. 3) Order 1995

Made 27th May 1995

    The Secretary of State, in exercise of the powers conferred on him by section 82(4) of the Deregulation and Contracting Out Act 1994[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
        1.    This Order may be cited as the Deregulation and Contracting Out Act 1994 (Commencement No. 3) Order 1995.
        2.    The provisions of the Deregulation and Contracting Out Act 1994 specified in article 3 below shall come into force on 1st July 1995.
        3.    The provisions referred to in article 2 above are—
       (a) section 13(1) and Schedule 5 (striking off of non-trading private companies registered in Great Britain);
       (b) section 13(2) and paragraphs 1 and 2 of Schedule 6 (striking off of non-trading private companies registered in Northern Ireland), insofar as is necessary to enable regulations to be made under Articles 603B(6)(f) and 603C(2)(f) of the Companies (Northern Ireland) Order 1986[2];
       (c) section 39 (Chapter II: consequential amendments) so far as relating to section 2(1) of the Company Directors Disqualification Act 1986[3]; and
       (d) in Schedule 11 (miscellaneous deregulatory provisions: consequential amendments), paragraph 6.
        4.    Insofar as they are not yet in force, the provisions of the Deregulation and Contracting Out Act 1994 specified in article 5 below shall come into force on 1st November 1995.
        5.    The provisions referred to in article 4 above are—
       (a) section 13(2) and Schedule 6;
       (b) section 39 so far as relating to Article 5(1) of the Companies (Northern Ireland) Order 1989[4]; and
       (c) in Schedule 11, paragraph 10.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 1st July 1995 provisions of the Deregulation and Contracting Out Act 1994 amending the Companies Act 1985 to provide for a new procedure for the directors of a non-trading private company to apply to the registrar of companies for the company's name to be struck off the register. A consequential amendment to the Company Directors Disqualification Act 1986 is also brought into force on 1st July 1995. Equivalent amendments to the Companies (Northern Ireland) Order 1986 and to the Companies (Northern Ireland) Order 1989 are brought into force on 1st November 1995, save that the provisions of section 13(2) of, and paragraphs 1 and 2 of Schedule 6 to, the Deregulation and Contracting Out Act which enable regulations to be made under new Articles 603B(6)(f) and 603C(2)(f) of the Companies (Northern Ireland) Order 1986 are brought into force on 1st July 1995.
