LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Authorities (Discretionary Expenditure Limits) (England) Order 1995

Made 9th March 1995
Laid before Parliament 9th March 1995
Coming into force 1st April 1995

    The Secretary of State, in exercise of the powers conferred on him by section 137(4AA) and (5) of the Local Government Act 1972[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation, commencement and application
        1.—(1)  This Order may be cited as the Local Authorities (Discretionary Expenditure Limits) (England) Order 1995 and shall come into force on 1st April 1995.

        (2)  This Order applies to local authorities in England only.
    Expenditure limits
        2.    For the purposes of section 137(4)(a)[2] of the Local Government Act 1972, there is hereby specified the sum of £3.80 in relation to —
       (a) a county council which is also exercising the functions of a district council pursuant to an order made under section 17 of the Local Government Act 1992[3]("a structure change order"); and
       (b) a district council which is also exercising the functions of a county council pursuant to a structure change order.

EXPLANATORY NOTE

(This note is not part of the Order)
    The annual limit on the amount of expenditure which a local authority may incur for purposes not otherwise authorised is determined under section 137(4) of the Local Government Act 1972 by multiplying the relevant population of the authority's area by the sum appropriate to the authority.
    Article 2 of this Order, which applies to local authorities in England only, specifies a sum for county and district councils which also exercise the functions of the other tier following a structure change order made under the Local Government Act 1992.
