EDUCATION, ENGLAND AND WALES

The Education (School Financial Statements) (Prescribed Particulars etc.) (Amendment) Regulations 1995

Coming into force 31st March 1995

    In exercise of the powers conferred by sections 42(4) and (6) to (8) and 232(5) and (6) of the Education Reform Act 1988[1], the Secretary of State for Wales hereby makes the following Regulations:
        1.—(1)  These Regulations may be cited as the Education (School Financial Statements) (Prescribed Particulars etc.) (Amendment) Regulations 1995.

        (2)  These Regulations shall come into force on 31st March 1995.
        2.    Regulation 5(2) of the Education (School Financial Statements) (Prescribed Particulars etc.) Regulations 1994[2] shall be amended as follows—
       (a) by the insertion after "year" in sub-paragraph (c) of the words "(including the amount referred to in sub-paragraph (i) below)";
       (b) by the insertion after "above" in sub-paragraph (d) of the words "or (i) below";
       (c) by the insertion after "decrease" in sub-paragraph (e) of the words "(including the amount referred to in sub-paragraph (h) below)"; and
       (d) by the insertion after sub-paragraph (g) of the following sub-paragraphs—
          "(h) in relation to a financial year beginning on or after 1st April 1995, the total amount of any reduction in the course of the financial year in the school's budget share pursuant to section 262(4)(a) of the Education Act 1993 (reduction arising from the permanent exclusion of pupils); and
          (i) in relation to such a financial year, the total amount allocated in the course of the financial year for the purposes of the school pursuant to section 262(4)(b) of the Education Act 1993 (increased funding for the admission of pupils permanently excluded by other schools)." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend regulation 5 of the Education (School Financial Statements) (Prescribed Particulars etc.) Regulations 1994 so that, in relation to financial years beginning on or after 1st April 1995, outturn statements will be required to include additional information relating to reductions and increases in a school's budget share by virtue of section 262(4) of the Education Act 1993 (in consequence of the permanent exclusion of pupils from the school or, as the case may be the admission of pupils permanently excluded by other schools).
