The Textile Products (Indications of Fibre Content) (Amendment) Regulations 1994

    The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to provisions concerning the composition, labelling, marketing, classification or description of textiles and products incorporating textiles, in exercise of the powers conferred by that section hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Textile Products (Indications of Fibre Content) (Amendment) Regulations 1994 and shall come into force on 1st June 1994.
        2.    The Textile Products (Indications of Fibre Content) Regulations 1986[3] are hereby amended—
       (a) by the substitution for regulation 5(3) of the following:—
        "In the case of any supply of, or any offer to supply, textile products other than one to which the requirements contained in paragraph (2) above apply, an indication of the fibre content of the textile products shall be given —
          (a) where there are accompanying commercial documents, by the inclusion of such an indication in those commercial documents; and
          (b) in all other cases, either by marking or labelling the products or, where the products are supplied or offered for supply in packing, by marking or labelling the packing." ; and
       (b) by the deletion in paragraph 5(5) of Schedule 1 of the words "or "pure cotton warp—pure linen weft"".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Textile Products (Indications of Fibre Content) Regulations 1986 ("the principal Regulations"), as amended by the Textile Products (Indications of Fibre Content) (Amendment) Regulations 1988, which implement Council Directives No. 71/307/EEC (OJ No.
    L185, 16.8.71, p. 16) and No. 83/623/EEC (OJ No. L353, 15.12.83, p. 8) and Commission Directive No. 87/140/EEC (OJ No. L56, 26.2.87, p. 24) relating to textile names and which require that when textile products are supplied or offered for supply commercially or are described in certain advertisements an indication of their fibre content shall be given.
    The principal Regulations are amended in two respects to correct minor errors in the implementation of the Community legislation. First, they are amended to require that where textile products are supplied or offered for supply, other than in specified circumstances, with accompanying commercial documents, an indication of fibre content must appear in those commercial documents (regulation 5(3)). Before amendment, the principal Regulations provided that such indication might be given by one or more of three methods which included setting it out in accompanying commercial documents. Second, the principal Regulations are amended to remove the option to describe certain textile products as "pure cotton warp pure linen weft" (Schedule 1, paragraph 5(5)).
