NATIONAL LOTTERY

The National Lottery Regulations 1994

The Secretary of State, in exercise of the powers conferred by section 12 of the National Lottery etc. Act 1993^[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:-

Citation, commencement and extent
    1.—(1)  These Regulations may be cited as the National Lottery Regulations 1994 and shall come into force on 1st April 1994.

    (2)  These Regulations extend to Northern Ireland.

Interpretation
    2.    In these Regulations-

"the Act" means the National Lottery etc. Act 1993; and

"National Lottery ticket" means a ticket or chance in a lottery that forms part of the National Lottery.

Age restriction on sales of National Lottery tickets
    3.    No National Lottery ticket shall be sold by or to a person who has not attained the age of 16 years.

Prohibition on sales of or invitations to purchase National Lottery tickets in a street
    4.—(1)  Subject to paragraph (2) below no National Lottery ticket shall be sold to a person, nor shall a person be invited to purchase a National Lottery ticket, in any street.

    (2)  Paragraph (1) above shall not have effect in relation to the sale of or invitation to purchase a National Lottery ticket by a person present in a kiosk or shop premises having no space for the accommodation of customers.

    (3)  In this regulation "street" includes any bridge, road, lane, footway, subway, court, alley or passage, whether a thoroughfare or not, which is for the time being open to the public without payment.

Prohibition of sales of or invitations to purchase National Lottery tickets on certain premises
    5.—(1)  No National Lottery ticket shall be sold to a person, nor shall a person be invited to purchase a National Lottery ticket-
 (a) in any licensed betting office within the meaning of the 1963 Act or licensed office within the meaning of the 1985 Order;
 (b) on any approved racecourse within the meaning of the 1963 Act on a day on which horse races take place thereon;
 (c) on any licensed track within the meaning of the 1963 Act on any day on which under sections 5, 6 and 20 of that Act bookmaking may lawfully be carried out on the track or on any licensed track within the meaning of the 1985 Order on any day on which under articles 36, 47 and 48 of that Order betting may lawfully be carried out on the track;
 (d) in any premises used wholly or mainly for providing amusements in the form of amusements with prizes or of amusements by means of slot machines or both; or
 (e) in any bingo or other gaming club, that is to say, in any premises in respect of which a licence under the Gaming Act 1968^[2] is for the time being in force or in any bingo club premises within the meaning of the 1985 Order.

    (2)  In paragraph (1) above-
 (a) "the 1963 Act" means the Betting, Gaming and Lotteries Act 1963^[3]; and
 (b) "the 1985 Order" means the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985^[4].

Restriction on sales of National Lottery tickets by vending machines
    6.—(1)  No National Lottery ticket shall be sold by means of a vending machine unless such machine is, at all times when tickets can be sold by means of it, attended by a person authorised by either-
 (a) the holder of the licence under section 5 of the Act; or
 (b) the holder of a licence under section 6 of the Act which authorises the promotion of the lottery, the tickets or chances of which are being sold by means of the vending machine.

    (2)  A vending machine shall not be treated as attended for the purposes of this regulation unless the person attending the vending machine is in a position where he can control the operation of the machine and in particular take action to prevent the purchase of tickets by any person whom he believes has not attained the age of 16 years.

Restriction on sales of or invitations to purchase National Lottery tickets at a person's home
    7.    No National Lottery ticket shall be sold, nor shall a person be invited to purchase a National Lottery ticket, by a person when visiting any other person at his home in the discharge of any official, professional or commercial function (including the function of selling National Lottery tickets).

These regulations impose various prohibitions and restrictions in relation to the sales of tickets in lotteries forming part of the National Lottery.

Regulation 3 provides that no National Lottery ticket shall be sold by or to a person who is aged under 16. Regulations 4 and 5 prohibit sales of or invitations to purchase National Lottery tickets in a street and on certain premises. Regulation 6 imposes restrictions on sales of National Lottery tickets by means of vending machines and regulation 7 imposes restrictions on sales of or invitations to purchase National Lottery tickets at a person's home.
