ENVIRONMENTAL PROTECTION

The Environmental Protection Act 1990 (Commencement No. 16) Order 1994

Made 6th November 1994

    The Secretary of State, in exercise of his powers under section 164(3) of the Environmental Protection Act 1990[1], hereby makes the following Order:
    Citation
        1.    This Order may be cited as the Environmental Protection Act 1990 (Commencement No. 16) Order 1994.
    Provision coming into force on or after 1st December 1994
        2.—(1)  Section 162(2) of the Environmental Protection Act 1990, insofar as it relates to the repeal of the Alkali, &c. Works Regulation Act 1906[2] ("the 1906 Act") in Part I of Schedule 16, shall come into force, for the purposes of the application of the 1906 Act to activities which fall within a description of a process which has been but has ceased to be a prescribed process—
       (a) on 1st December 1994; or, if later,
       (b) on the date on which that description of process ceases to be a prescribed process.

        (2)  In this article "prescribed process" has the meaning given in section 1 of the Environmental Protection Act 1990.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force the repeal of the Alkali, &c. Works Regulation Act 1906, for the purposes of the application of that Act to activities which fall within a description of process which has been but has ceased to be a prescribed process for the purposes of Part I of the Environmental Protection Act 1990, on 1st December 1994 or, if later, on the date on which that description of process ceases to be so prescribed.
