AGRICULTURE

The Beef Carcase (Classification) (Amendment) Regulations 1994

Coming into force 29th November 1994

    The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting jointly in exercise of the powers conferred upon them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

    Title, extent and commencement
        1.    These Regulations, which may be cited as the Beef Carcase (Classification) (Amendment) Regulations 1994, shall extend to Great Britain and shall come into force on 29th November 1994.
    Amendments to the Beef Carcase (Classification) Regulations 1991
        2.—(1)  The Beef Carcase (Classification) Regulations 1991[3] shall be amended in accordance with the following paragraphs of this regulation.

        (2)  In paragraph (1) of regulation 2—
       (a) in the definition of "Commission Regulation" insert—

      ", as amended by Commission Regulation (EEC) No. 2191/93[4]" after "animals";
         (b) delete the definition of "pistola cut carcase"; and
         (c) for the definition of "regulated carcase" to the end of the paragraph substitute the following text—
          ""regulated carcase" means the carcase or half-carcase[5] of an adult bovine animal which has been marked in accordance with regulation 11(2) of and paragraph 1 of Schedule 12 to the Fresh Meat (Hygiene and Inspection) Regulations 1992[6];
          "regulated slaughterhouse" means a slaughterhouse (as defined by regulation 2(1) of the Fresh Meat (Hygiene and Inspection) Regulations 1992) in which regulated carcases are produced;
          "veterinary approval number" means the serial number allocated in relation to the licensing of a regulated slaughterhouse under Part II of the Fresh Meat (Hygiene and Inspection) Regulations 1992." .

        (3)  In regulation 5—
       (a) delete "as" where it first occurs; and
       (b) delete the text from and including "or" to the end of the regulation.

        (4)  In regulation 6—
       (a) delete "as" where it first occurs; and
       (b) delete the text from and including "or" to the end of the regulation.

        (5)  In regulation 14(2)(a) insert "other" before "requirement".

        (6)  Delete Schedule 3.

EXPLANATORY NOTE

(This note is not part of the Regulations)
        1.    These Regulations, which extend to Great Britain, make a number of textual changes to the Beef Carcase (Classification) Regulations 1991 (S.I. 1991/2242).
        2.    Schedule 3 to and parts of regulations 5 and 6 of those Regulations, which also extend to Great Britain, were enacted to give effect to the last sentence of Article 1(1) of Commission Regulation (EEC) No. 344/91 (OJ No. L41, 14.2.91, p.15), which provision enabled beef carcases to be stamped on the inside surface. That provision was amended by Commission Regulation (EEC) No. 2191/93 (OJ No. L196, 5.8.93, p.17) and all beef carcases are now by virtue of the said Article 1(1) required to be marked or labelled on the outside surface.
        3.    These Regulations revoke the provisions of S.I. 1991/2242 referred to in paragraph 2 above (together with a definition in regulation 2(1) of that instrument relevant only to those provisions) and all beef carcases must now under the said instrument be marked or labelled on the outside surface.
        4.    In addition, these Regulations—
      (a) amend the definition of Commission Regulation (EEC) No. 344/91 found in regulation 2(1) of S.I. 1991/2242 in the light of the aforementioned amendment to it;
      (b) substitute, in the said regulation 2(1), revised definitions of "regulated carcase", "regulated slaughterhouse" and "veterinary approval number" in the light of the enactment of the Fresh Meat (Hygiene and Inspection) Regulations 1992 (S.I. 1992/2037); and
      (c) correct textual inaccuracies in regulations 5, 6 and 14(2)(a) of S.I. 1991/2242.
