The Rivers Tweed and Eye Protection (Renewal) Order 1991 Variation Order 1994

Made 6th October 1994
Coming into force 7th October 1994

    The Secretary of State, in exercise of the powers conferred on him by section 1(10) of the Freshwater and Salmon Fisheries (Scotland) Act 1976[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Rivers Tweed and Eye Protection (Renewal) Order 1991 Variation Order 1994 and shall come into force on 7th October 1994.
    Variation
        2.    The Rivers Tweed and Eye Protection (Renewal) Order 1991[2] shall be varied by omitting, in article 4, the words "During the period from 8th October 1991 to 7th October 1994, both dates inclusive,".

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order varies the prohibition contained in article 4 of the Rivers Tweed and Eye Protection (Renewal) Order 1991 ("the 1991 Order") which prohibits fishing for or taking freshwater fish in inland waters in the area prescribed without legal right or without written permission from someone having such a right.
    The effect of the variation is to continue the 1991 Order in force for an unlimited period.
    The prescribed area referred to consists of those parts of Borders, Lothian and Strathclyde Regions as lie within so much of the catchment area of the Rivers Tweed and Eye as lies in Scotland. The area is illustrated on a map attached to the Rivers Tweed and Eye Protection Order 1980 ("the 1980 Order") and is defined by reference to a detailed large scale map which may be inspected at the Scottish Office Agriculture and Fisheries Department, Pentland House, Robb's Loan, Edinburgh on any working day between 10.00am and 4.00pm.
    The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
    The 1980 Order was renewed in accordance with the Orders listed in footnote (a) to article 2.
