FIRE PRECAUTIONS

The Fire Precautions (Sub-surface Railway Stations) (Amendment) Regulations 1994

Laid before Parliament 26th August 1994
Coming into force 1st January 1996

    In exercise of the powers conferred on me by sections 12(1), (3) and (4), 37(2) and (3) and 40(1) of the Fire Precautions Act 1971[1], and having consulted with such persons and bodies of persons as appear to me requisite, I hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Fire Precautions (Sub-surface Railway Stations) (Amendment) Regulations 1994 and shall come into force on 1st January 1996.
    Exemption from requirements
        2.    Regulation 12 of the Fire Precautions (Sub-surface Railway Stations) Regulations 1989[2] is amended—
       (a) in paragraph (1) by inserting—
         (i) after the words "regulations 4(1) and (3), 5(4) and (5), 6(1) and (3), 7(1), 8(2)" the words "and (3)", and
         (ii) after the words "they may" the words ", subject to paragraph (1A),"; and
       (b) by inserting after paragraph (1)—
        "  (1A)  A fire authority may not exercise their powers under paragraph (1) above in such a way that there would be in effect at the same time in respect of particular station premises exemptions from requirements of regulation 5(4) or 6(1) and from requirements of regulation 8(3)." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Fire Precautions (Sub-surface Railway Stations) Regulations 1989 so as to add the requirement imposed by regulation 8(3) (flame resistant materials to be used for escalator surfaces) to those from which a fire authority may grant exemption under regulation 12(1); escalators in a station may not, however, at the same time be exempt from the regulation 8(3) requirement and from requirements as to water sprinklers or as to means for detecting fire.
    Regulation 8(3) of the 1989 Regulations comes into force on 1st January 1996 (see regulation 1(3)). These amending Regulations accordingly come into force on that date.
