The International Transport Conventions Act 1983 (Amendment) Order 1994

The Queen's Most Excellent Majesty in Council

    Whereas it appears that Her Majesty's Government in the United Kingdom have agreed to a revision of the Convention set forth in the Protocol amending the Convention concerning International Carriage by Rail (COTIF) signed at Berne on 9th May 1980, adopted by the 2nd General Assembly of the Intergovernmental Organisation for International Carriage by Rail (OTIF) constituted by the Convention held at Berne from 17th to 20th December 1990[1] (hereinafter called "the Protocol"):
    And whereas a draft of this Order has been laid before Parliament in accordance with section 8(3) of the International Transport Conventions Act 1983[2] and has been approved by a resolution of each House of Parliament:
    Now, therefore, Her Majesty, in exercise of the powers conferred by section 8(1) of the International Transport Conventions Act 1983 and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
    Citation and commencement
        1.    This Order may be cited as the International Transport Conventions Act 1983 (Amendment) Order 1994 and shall come into force on the date the Protocol comes into force which date shall be notified in the London, Edinburgh and Belfast Gazettes.
    Amendment of the International Transport Conventions Act 1983
        2.    In section 1(3) of the International Transport Conventions Act 1983 (which specifies the provisions of the Convention having the force of law), in paragraph (a) at the end of sub-paragraph (ii) for the full stop there shall be substituted ", and" and the following sub-paragraph shall be added—
        "(iii) the Protocol amending the Convention adopted by the 2nd General Assembly of the Intergovernmental Organisation for International Carriage by Rail (OTIF) constituted by the Convention held at Berne from 17th to 20th December 1990 as presented to Parliament in 1993 and set out in Command Paper 2232" .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends section 1 of the International Transport Conventions Act 1983 which gives the force of law in the United Kingdom to the Convention concerning International Carriage by Rail signed on behalf of the United Kingdom on 9th May 1980 (Cm 2312). The Order takes account of amendments to be made by the Protocol adopted by the 2nd General Assembly of the Intergovernmental Organisation for International Carriage by Rail constituted by Article 1 of the Convention. The amendments were adopted under Article 20(1) of the Convention and are not yet in force. Under Article 20(2) of the Convention they will come into force when more than two-thirds of the Member States of the Organisation have ratified, accepted or approved the Protocol. The date when they come into force for the United Kingdom will be notified in the London, Edinburgh and Belfast Gazettes.
