HARBOURS, DOCKS, PIERS AND FERRIES

The Lerwick Harbour Revision Order 1994

Made 4th July 1994
Coming into force 11th July 1994

    Whereas the Trustees of the Port and Harbour of Lerwick have applied for a harbour revision order under section 14 of the Harbours Act 1964[1];
    And whereas no objection to the application has been made pursuant to paragraph 3(a) of Schedule 3 to the said Act[2];
    And whereas the Secretary of State for Transport is satisfied as mentioned in subsection (2)(b) of the said section 14:
    Now therefore, the Secretary of State for Transport (being the appropriate Minister under subsection (7) of the said section 14[3]), in exercise of powers conferred by that section and now vested in him[4], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and Commencement
        1.—(1)  This Order may be cited as the Lerwick Harbour Revision Order 1994 and shall come into force on 11th July 1994.

        (2)  The Lerwick Harbour Acts and Orders 1877 to 1993 and this Order may be cited together as the Lerwick Harbour Acts and Orders 1877 to 1994 (hereinafter referred to as "the Harbour Acts and Orders").
    Interpretation
        2.    In this Order, unless the context otherwise requires:
      "electoral divisions of the Shetland Islands Area" means the electoral divisions into which the Shetlands Islands Area is divided by the Shetland Islands Area (Electoral Arrangements) Order 1992[5];

      "Order of 1975" means the Lerwick Harbour (Miscellaneous Provisions) Order 1975[6];

      "the Trustees" means the Trustees of the port and harbour of Lerwick for the time being acting under the Harbour Acts and Orders.

    Amendment of Order of 1975
        3.    Section 5(1) of the Order of 1975 shall be amended by omitting the word "six" where it secondly appears.
        4.    For the purposes only of section 5(1) of the Order of 1975 (as hereby amended) "the electoral divisions of Lerwick" means such of the electoral divisions of the Shetland Islands Area as include "Lerwick" in their names, excluding the division named "Lerwick Harbour and Bressay".

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the provisions for the appointment by the Shetland Islands Council of trustees of the port and harbour of Lerwick.The amendments take into account changes in the electoral divisions of the Shetland Islands Area.
