ROAD TRAFFIC

The Road Traffic Act 1991 (Commencement No. 11 and Transitional Provisions) Order 1994

Made 3rd June 1994

    The Secretary of State for Transport, in exercise of the powers conferred by section 84 of the Road Traffic Act 1991[1], hereby makes the following Order:
    Citation and interpretation
        1.—(1)  This Order may be cited as the Road Traffic Act 1991 (Commencement No.11 and Transitional Provisions) Order 1994.

        (2)  In this Order—
      "the 1991 Act" means the Road Traffic Act 1991;

      "the scheduled boroughs" means the City of London and the London boroughs whose names are included in the Schedule to this Order and a reference to the councils of the Scheduled boroughs includes, in relation to the City of London, the Common Council of the City of London;

      "vehicle" has the meaning given by section 99(5) of the Road Traffic Regulation Act 1984[2].

    Commencement and transitional provisions
        2.    The following provisions of the 1991 Act shall come into force on 4th July 1994 in respect of each of the scheduled boroughs—
       (a) section 64, to the extent that it is not already in force;
       (b) section 65;
       (c) section 66, to the extent that it is not already in force;
       (d) section 69;
       (e) section 81, to the extent necessary for bringing into force the provisions of Schedule 7 brought into force by this article; and
       (f) paragraph 5 of Schedule 7, to the extent that that paragraph is not already in force.
        3.    Subsections (4) and (6) of section 67 of the 1991 Act shall come into force on 4th July 1994 for the purpose of the application of the subsections thereby inserted in relation to vehicles found in any of the scheduled boroughs.
        4.    Subection (2)(b) of section 68 of the 1991 Act shall come into force on 4th July 1994 for the purpose of the application of the subsection thereby inserted in relation to the councils of the scheduled boroughs.
        5.—(1)  In relation to a vehicle that is stationary in a designated parking place in one of the scheduled boroughs immediately before 4th July 1994, section 66(2) of the 1991 Act shall have effect for so long as it remains in that parking place as if the words "on or after 4th July 1994"were inserted after—
       (a) the word "left" in paragraph (a) of section 66(2),
       (b) the word "payable" in paragraph (b) of that subsection, and
       (c) the word "has" in paragraph (c) of that subsection.

        (2)  Where a vehicle found in one of the scheduled boroughs has, pursuant to any enactment, been removed before 4th July 1994, sections 67 and 68 of the 1991 Act shall not apply in relation to that removal or to any storage or disposal of the vehicle as a consequence of that removal.
