NATIONAL LOTTERY

BETTING, GAMING AND LOTTERIES

The National Lottery etc. Act 1993 (Commencement No. 2 and Transitional Provisions) Order 1994

Made 10th April 1994

    The Secretary of State, in exercise of the powers conferred on him by section 65 together with section 60(5) of the National Lottery etc. Act 1993[1], hereby makes the following Order:
    Citation and interpretation
        1.—(1)  This Order may be cited as the National Lottery etc. Act 1993 (Commencement No. 2 and Transitional Provisions) Order 1994.

        (2)  In this Order "the Act" means the National Lottery etc. Act 1993.
    Provisions coming into force on 3rd May 1994
        2.    The following provisions of the Act shall come into force on 3rd May 1994:

    sections 48 and 49,

    sections 51 to 55,

    section 64 so far as not yet in force,

    Schedules 7 and 8,

    Schedule 10 so far as not yet in force.
    Provisions coming into force on 3rd October 1994
        3.    The following provisions of the Act shall come into force on 3rd October 1994:

    section 50,

    Schedule 9.
    Transitional provisions
        4.    For the purposes of determining whether section 5(3C) or (3D) of the Lotteries and Amusements Act 1976[2] ("the 1976 Act") (which was inserted by section 48(3) of the Act) applies to a lottery, any earlier lottery (within the meaning of section 5 of the 1976 Act) shall be disregarded if the date of the lottery fell before 3rd May 1994.
        5.    The following provisions of the Lotteries and Amusements Act 1976, namely-
       (a) section 11(4A) (which was inserted by section 52(4) of the Act);
       (b) section 11(14) (which was inserted by section 52(8) of the Act);
       (c) paragraph 11(cc) of Schedule 1 (which was inserted by paragraph 7 of Part I of Schedule 7 to the Act);
    shall not have effect in relation to any lottery in respect of which any tickets or chances have been sold before 3rd May 1994.
        6.    The amendments made to section 11(13) of the Lotteries and Amusements Act 1976[3] ("the 1976 Act") by section 52(7) of the Act shall not have effect in relation to any lottery in respect of which any tickets or chances have been sold before 3rd May 1994 but section 11(13) of the 1976 Act shall apply to any such lotteries as if it had not been amended.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force
      (a) on 3rd May 1994 sections 48 and 49 and 51 to 55 and the remainder of section 64 of, and Schedules 7 and 8 and the remainder of Schedule 10 to, the National Lottery etc. Act 1993 (which make provision in relation to the registration of societies and local lottery schemes, the frequency and conduct of lotteries, offences in connection with lotteries and supplementary provisions).
      (b) on 3rd October 1994 section 50 of, and Schedule 9 to, that Act (which make provision in relation to the conduct of societies' and local lotteries by lottery managers).

    This Order also makes transitional provision in relation to the amendments made to sections 5 and 11 of, and paragraph 11 of Schedule 1 to, the Lotteries and Amusements Act 1976 by sections 48 and 52 of, and paragraph 7 of Part I of Schedule 7 to, the National Lottery etc. Act 1993 (which relate to the registration of societies, the rules for societies' and local lotteries and the matters to be specified in returns for societies' lotteries).



NOTE AS TO EARLIER COMMENCEMENT ORDERS

(This note is not part of the Order)

    This Order has been preceded by the National Lottery etc. Act 1993 (Commencement No. 1 and Transitional Provisions) Order 1993 (S.I. 1993/2632). That Order brought certain provisions of that Act into force on two different dates.
