COURT OF SESSION, SCOTLAND

The Appointment of Judges as Arbiters (Fees) (Scotland) Order 1993

Made 8th December 1993
Laid before Parliament 20th December 1993
Coming into force 11th January 1994

    The Secretary of State, in exercise of the powers conferred on him by section 17 of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1980[1] and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Order:
        1.    This Order may be cited as the Appointment of Judges as Arbiters (Fees) (Scotland) Order 1993 and shall come into force on 11th January 1994.
        2.    The fees payable for the services of a Senator of the College of Justice as an arbiter or oversman shall be-
       (a) £1,350 on appointment; and
       (b) £1,350 in respect of each day or part thereof (after the first day) of the hearing of the reference before him.
        3.    The Appointment of Judges as Arbiters (Fees) (Scotland) Order 1980[2] is hereby revoked.

    This Order increases the fees payable in the Court of Session when a judge of the Court of Session is appointed to act as an arbiter or oversman in an arbitration of a commercial character.
