The Farm and Conservation Grant (Variation) Scheme 1993

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 28 and 29 of the Agriculture Act 1970[1], and of all other powers enabling them in that behalf, with the approval of the Treasury, hereby make the following Scheme:
    Title, commencement and interpretation
        1.—(1)  This Scheme may be cited as the Farm and Conservation Grant (Variation) Scheme 1993 and shall come into force on 1st December 1993.

        (2)  In this Scheme "the principal Scheme" means the Farm and Conservation Grant Scheme 1989[2].
    Savings
        2.    Paragraph 7(a)-(e) of this Scheme shall not apply in relation to any claim for grant towards expenditure incurred for the purposes of the principal Scheme before 1st December 1993 and those provisions of this Scheme shall not affect the operation of the principal Scheme in relation to any such claim for grant.
    Variation of the principal Scheme
        3.    The principal Scheme shall be further varied in accordance with the following paragraphs of this Scheme.
        4.    In paragraph 3(1) (payment of grants), after sub-paragraph (a)(iv) there shall be inserted the following sub-paragraph:
        "(v) on or after 1st December 1993 in respect of any work, facility or transaction of a kind specified in paragraph 9A in column 1 of Schedule 1;" .
        5.    In paragraph 5 (amounts of grant), in sub-paragraphs (1) and (4), for the words "paragraphs 1 to 9" there shall be substituted the words "paragraphs 1 to 9A".
        6.—(1)  In paragraph 7(2) (closing dates for claims and incurring certain expenditure), in sub-paragraph (c), for the date "16th November 1994" there shall be substituted the date "16th November 1995".

        (2)  In paragraph 7(3), in sub-paragraph (b), for the date "17th November 1993" there shall be substituted the date "17th November 1994".
        7.    In Schedule 1 ("ELIGIBLE WORKS, FACILITIES AND TRANSACTIONS AND RATES OF GRANT")—
       (a) in each of paragraphs 1(a) and (d)(i), 2, 3 and 4, in column 2, for the figure "40" there shall be substituted the figure "25", and in column 3, for the figure "50" there shall be substituted the figure "30";
       (b) in paragraph 1(b)—
         (i) in column 1, the words "(except those specified in sub-paragraph (c) below)" shall be deleted; and
         (ii) in columns 2 and 3, for the figure "50" there shall be substituted the figure "25";
       (c) paragraph 1(c) shall be deleted;
       (d) in paragraph 1(d)(ii), in column 3, for the figure "50" there shall be substituted the figure "30";
       (e) in paragraph 5, in column 2, for the figure "35" there shall be substituted the figure "20", and in column 3, for the figure "35" there shall be substituted the figure "25";
       (f) after the entries numbered 9, there shall be inserted the following entries in columns 1, 2 and 3—
              "9A.    Provision and installation of means of public access to agricultural land (including field gates, stiles and footbridges).

       (g) in paragraph 10, for the words "paragraphs 1 to 9" there shall be substituted the words "paragraphs 1 to 9A".

EXPLANATORY NOTE

(This note is not part of the Scheme)
    This Scheme further varies the Farm and Conservation Grant Scheme 1989 ("the principal Scheme") and complies with Article 12 of Council Regulation (EEC) No.2328/91 (OJ No.L218, 6.8.91, p. 1) on improving the efficiency of agricultural structures. The Scheme—
        (1)  changes, from 16th November 1994 to 16th November 1995 the closing date by which, for grant to be payable, claims for grant must be received in respect of certain items which are eligible for grant in the Isles of Scilly (paragraph 6(1));

        (2)  changes from 17th November 1993 to 17th November 1994 the closing date by which, for grant to be payable, expenditure must be incurred in respect of those items (paragraph 6(2));

        (3)  in relation to expenditure incurred for the purposes of the principal Scheme on or after 1st December 1993—
      (a) reduces the rates of grant in respect of a number of items (paragraph 7(a), (b)(ii), (d) and (e));
      (b) removes separate provision for payment of grant in respect of poultry manure stores (paragraph 7(b)(i) and (c));
      (c) provides for grant to be payable towards the cost of the provision to the public of access to agricultural land (paragraphs 4, 5 and 7(f) and (g)).
