TRANSPORT

The Meldon Quarry Branch Line Order 1993

Made 11th November 1993
Laid before Parliament 19th November 1993
Coming into force 1st February 1994

    The Secretary of State for Transport, in exercise of the powers conferred on him by section 4 of, and paragraph 8 of Schedule 1 to, the Transport Act 1981[1], hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Meldon Quarry Branch Line Order 1993 and shall come into force on 1st February 1994.
    Interpretation
        2.    In this Order
      "the Acts" means the Okehampton Railway Act 1862[2], the Okehampton Railway Act 1864[3] and the Devon and Cornwall Railway Act 1868[4];

      "the Company" means Euston Holdings Limited; and

      "the Designated Land" means the land in the County of Devon occupied by the line of railway (including Meldon Viaduct and the discontinued line of railway) from a point at Coleford Junction at 296 kilometres 31 metres from London Waterloo to a point 323 kilometres 580 metres from London Waterloo at the bridge to the south-west of Sourton Down known as bridge number 618.

    Amendment to the Acts
        3.    In so far as the Designated Land is thereby affected, for the references in the Acts to the British Railways Board or their predecessors there shall be substituted references to the Company.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order has the effect of transferring from the British Railways Board to Euston Holdings Limited, a wholly-owned subsidiary of the Board, certain rights and liabilities conferred or imposed by the Okehampton Railway Acts of 1862 and 1864 and the Devon and Cornwall Railway Act 1868, so far as such rights and liabilities relate o the lands described in article 2 of the Order.
