ENERGY CONSERVATION

The Home Energy Efficiency Grants (Amendment) Regulations 1993

Made 11th November 1993
Laid before the House of Commons 18th November 1993
Coming into force 9th December 1993

    The Secretary of State, in exercise of the powers conferred on him by section 15 of the Social Security Act 1990[1] and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Home Energy Efficiency Grants (Amendment) Regulations 1993 and shall come into force on 9th December 1993.

        (2)  In these Regulations, "the principal Regulations" means the Home Energy Efficiency Grants Regulations 1992[2].
    Amendment of the principal Regulations
        2.    For regulation 9 (calculation of the size of grant) of the principal Regulations substitute the following-

        "Calculation of the size of grant
            9.—(1)  The amount of any grant in respect of works at a dwelling shall be determined in accordance with the following Table and paragraphs (2) and (3)-
        Table
          (1)  Work under regulation
          (2)  Work carried out by applicant
          (3)  Work carried out by eligible contractor
        5(1)(a) £160.70 £198.70
        5(1)(b) £90.50 £128.50
        5(1)(c) £251.00 £305.00
        5(1)(d) No grant available £10.00


            (2)  Where the work is carried out by the applicant, the grant for the work specified in column (1) of the Table shall be the lesser of—
          (a) the cost of the materials used, and
          (b) the figure shown in column (2) of the Table.

            (3)  Where the work is carried out by an eligible contractor, the grant for the work specified in column (1) of the Table shall be the lesser of-
          (a) the amount properly charged for the work, and
          (b) the figure shown in column (3) of the Table." .

    Transitional and savings
        3.    In any case where an application under regulation 4 (application for a grant) of the principal Regulations was made in respect of any work before 9th December 1993, regulation 9 of those Regulations shall continue to apply for the determination of the amount of grant as if regulation 2 of these Regulations had not been made.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Home Energy Efficiency Grants Regulations 1992, which provide in particular for the making of grants for the improvement of energy efficiency in dwellings occupied by persons of low income. These Regulations substitute a new regulation 9 (calculation of the size of grant). The maximum amounts of the grants payable in respect of works at such dwellings are increased. Contributions from applicants for grants are no longer specified. The former regulation 9 continues to govern cases where grant was applied for before 9th December 1993.
