The Local Government Act 1988 (Defined Activities) (Exemption) (Horsham District Council and Worthing Borough Council) Order 1993

Made 15th September 1993
Laid before Parliament 24th September 1993
Coming into force 15th October 1993

    The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Horsham District Council and Worthing Borough Council) Order 1993 and shall come into force on 15th October 1993.
    Exemption of refuse collection
        2.—(1)  The collection of refuse by the Horsham District Council shall not be treated as a defined activity so long as it is undertaken in their area before 1st August 1996.

        (2)  The collection of refuse, and cleaning (other than cleaning of buildings), by the Worthing Borough Council shall not be treated as defined activities so long as they are undertaken in their area before 1st August 1995.

EXPLANATORY NOTE

(This note is not part of the Order)
    Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
    This Order exempts from the requirements of Part I the collection of refuse by the Horsham District Council so long as it is carried out in their area before 1st August 1996, and collection of refuse and cleaning (other than cleaning of buildings) by the Worthing Borough Council so long as they are carried out in their area before 1st August 1995.
