HOUSING, SCOTLAND

The Right to Purchase (Loan Application) (Scotland) Amendment Order 1993

Made 3rd September 1993
Coming into force 27th September 1993

    The Secretary of State, in exercise of the powers conferred on him by section 216(2)(b) of the Housing (Scotland) Act 1987[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Right to Purchase (Loan Application) (Scotland) Amendment Order 1993 and shall come into force on 27th September 1993.
        2.    The form in the Schedule to the Right to Purchase (Loan Application) (Scotland) Order 1980[2] is amended as follows:-
       (a) at the end of the first paragraph there shall be inserted the following paragraph:-
        "You cannot apply for a loan from any of the bodies mentioned above if you are applying to purchase under the rent to loan scheme." ; and
       (b) in section 5 for "industrial disease benefit:" there shall be substituted "industrial disablement benefit:".

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Right to Purchase (Loan Application) (Scotland) Order 1980 by adding a paragraph to the form in the Schedule to that Order informing borrowers of their being unable to borrow from a local authority, a new town development corporation or Scottish Homes when they are purchasing their house under the rent to loan scheme (introduced into the Housing (Scotland) Act 1987 by the Leasehold Reform, Housing and Urban Development Act 1993 (c. 28)) and by correcting a typographical error in section 5 in the form.
