The Gipsy Encampments (District of South Cambridgeshire) Order 1993

Made 16th July 1993
Laid before Parliament 23rd July 1993
Coming into force 13th August 1993

    The Secretary of State, being satisfied on the joint application of the Cambridgeshire County Council and the South Cambridgeshire District Council that in all the circumstances it is not necessary or expedient that adequate provision is made in the district of South Cambridgeshire for the accommodation of gipsies residing in or resorting to that district, in exercise of the powers conferred by section 12(2) of the Caravan Sites Act 1968[1], and now vested in him[2], hereby makes the following Order:
        1.    This Order may be cited as the Gipsy Encampments (District of South Cambridgeshire) Order 1993 and shall come into force on 13th August 1993.
        2.    The area of the district of South Cambridgeshire is designated as an area to which section 10 (prohibition of unauthorised camping in designated areas) of the Caravan Sites Act 1968 applies.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order designates the district of South Cambridgeshire as an area to which section 10 of the Caravan Sites Act 1968 applies.
    It is an offence within a designated area for a gipsy to station a caravan for the purpose of residing for any period on any land within the boundaries of a highway, or on any other unoccupied land, or on any occupied land without the consent of the occupier.
    Under section 11 of the Act (substituted by section 174 of the Local Government, Planning and Land Act 1980), unlawfully stationed caravans and their occupants may be removed by order of a magistrates' court.
