ENVIRONMENTAL PROTECTION

The Environmental Protection (Prescribed Processes and Substances) (Amendment) Regulations 1993

    The Secretary of State for the Environment as respects England, the Secretary of State for Wales as respects Wales, and the Secretary of State for Scotland as respects Scotland, in exercise of the powers conferred on them by section 2 of the Environmental Protection Act 1990[1] and of all other powers enabling them in that behalf, hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Environmental Protection (Prescribed Processes and Substances) (Amendment) Regulations 1993 and shall come into force on 30th July 1993.
    Amendment of regulations
        2.—(1)  The Environmental Protection (Prescribed Processes and Substances) Regulations 1991[2] shall be amended as follows.

        (2)  In Section 6.9 of Schedule 1 (the treatment and processing of animal or vegetable matter), at the end of the definition of "exempt process" (but before the word "and") there shall be added the following:
        "(iii) the fleshing, cleaning and drying of pelts of fur-bearing mammals;" .


        (3)  In each of the Tables in paragraphs 4 and 18 of Schedule 3 (period within which an application for an authorisation under section 6 of the Environmental Protection Act 1990 must be made for an existing process), for the date "31st July 1993" in the third column of the entry relating to "Section 4.1, 4.2, 4.7 or 4.8" there shall be substituted "31st October 1993".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Environmental Protection (Prescribed Processes and Substances) Regulations 1991.
    The effect of the amendments is—
      —to exempt from the prescribed process relating to the treatment and processing of animal or vegetable matter (Section 6.9 of Schedule 1 to those Regulations) the fleshing, cleaning and drying of pelts of fur-bearing mammals;

      —and to extend, from 31st July 1993 to 31st October 1993, the period within which an application for an authorisation under section 6 of the Environmental Protection Act 1990 must be made in respect of an existing process falling within Section 4.1, 4.2, 4.7 or 4.8 of Schedule 1 to those Regulations (petrochemical processes, manufacture and use of organic chemicals, pesticide production, and pharmaceutical production).
